Hon. David G. Bernthal, (Ret.), senior mediator and arbitrator at ADR Systems, is publishing a series of monthly columns, titled “Off the Bench,” in the Champaign-Urbana News-Gazette. His column provides insight into legal topics and is geared toward educating the public.

“My motivation is to educate non-lawyers on legal matters they may encounter but not know anything about,” said Judge Bernthal. “They will read a term or see something on the news but not fully understand what it means. I do my best, as a retired judge, to answer those questions.”

The most recent column, published August 13, 2017, was titled, “Many Factors in Determining Jurisdiction.” In the article, he explains the often-confusing concept of jurisdiction – why a particular case is pursued in a particular court.

Judge Bernthal welcomes comments, suggestions and questions to address in future columns.

“I regularly receive feedback from the community in Champaign County, but I’ve also had feedback from colleagues across the country,” he said. “I use that feedback and those questions to provide clarification and inspire future topics.”

Judge Bernthal is a former federal court judge who is highly regarded for his integrity and his calm temperament. He served 21 years as a federal magistrate judge in the US District Court for the Central District of Illinois. Those who practiced before him have praised his skills as a jurist, describing him as both a learned scholar and efficient administrator. Judge Bernthal’s proven legal knowledge and keen understanding of negotiation are critical assets in both mediation and arbitration.

Judge Nudelman was excellent.  Many times, attorneys on the case wanted to terminate the mediation, but Judge Nudelman kept us going until it was resolved.  Great job!!
