Hon. Robert V. Boharic, (Ret.) has extensive experience in resolving multi-party commercial disputes, including partnership dissolution, real estate, government and administrative law matters, personal injury, product liability and medical malpractice.  Having practiced law as both plaintiff and defense counsel, he brings a unique and thoughtful approach to mediations and arbitrations. Judge Boharic is often selected for the most complicated and sensitive matters.  For example, Judge Boharic was chosen to either mediate or defend numerous cases of claimed clergy abuse involving a religious organization and its clergy.

ADR Experience and Qualifications

  • Since joining ADR Systems in 2003, Judge Boharic has served as a mediator, arbitrator, tri-panel chair, special master and neutral fact finder
  • 18-year judicial career focused on commercial, civil and criminal litigation, serving six years in Chancery, six years in Law Division and six years in Criminal Division
  • 11-year legal career including Associate at Clausen & Miller, 1983-1984; Partner at Boharic & Theobald, 1981-1983; Assistant State’s Attorney, Cook County, felony trial supervisor, 1973-1981
  • While in Chancery, Judge Boharic conducted hundreds of settlement conferences; his settlement success was well-known, and other judges frequently sent difficult cases to him for mediation
  • Since his retirement from the bench in 2002, Judge Boharic has continued to serve as a Receiver, Guardian Ad Litem, Commissioner and approved mediator for the Circuit Court of Cook County, as well as a consultant in litigation strategy and valuation of cases for both plaintiffs and defendants
  • Appointed by the Circuit Court of Cook County to serve as a claims administrator on the Crestwood class action

Representative Cases

  • Business Dissolution: managed six years of disputes in liquidation of insurance company; presided over bench trial
  • Class Action: as a judge, ruled unconstitutional the Municipal Telecommunications Infrastructure Maintenance Fee; after case was affirmed by the Illinois Supreme Court, certified class and mediated settlement with various parties, including the City of Chicago
  • Class Action: as a judge, ruled on nationwide class action against large telecommunications company, plaintiffs alleged company fraudulently sold out-of-date analog radio systems during switch to digital technology
  • Family Business: family member’s battle for control of a religious foundation
  • Government: significant and hotly-contested zoning case with the municipality seeking to demolish an architecturally important local school; presided over bench trial
  • Government: constitutional challenge to the Illinois Legislature’s attempt to locate a riverboat in a metropolitan suburb
  • Government: city changed zoning laws with developer seeking to enforce rights
  • Insurance Coverage and Subrogation: art galleries consumed in fire led to massive litigation; mediated settlement between the galleries and other injured parties and the group who allegedly allowed the fire to start
  • Medical Malpractice: stroke victim claimed misdiagnosis led to blindness
  • Product Liability: as a judge, applied the learned intermediary doctrine to the use of oral contraceptives when federal regulation required warning the patient
  • Product Liability: claim involving soy-based infant formula that caused learning disabilities and interference with growth because it lacked proper amounts of chloride
  • Toxic Tort: hospital nurses made toxic tort claim against manufacturer of ethylene oxide used to sterilize instruments
