How to Write an Effective Mediation Submission - ADR Systems

ADR Systems

ADR Systems has recently published an article written by Hon. James P. Etchingham, (Ret.) and Jann Johnson in the Chicago Daily Law Bulletin that summarizes the key elements of a compelling mediation submission.

The article, titled “Writing an Effective Mediation Submission,” also provides attorneys with a submission checklist. The checklist lists the sections of a submission and includes further detail about what to include in each section.

Mediators rely on the information they receive in submissions in order to properly mediate a case. Well-written submissions that include all of the information outlined in the checklist will go a long way toward having a successful mediation.

Judge Burke successfully mediated a complicated case with little chance of being resolved.  He read every word of the parties' submissions, asked astute questions, and worked hard to find a path to resolution.  Judge Burke communicated with the parties themselves - so that they felt they were important participants in working toward resolution. The case I thought was never going to settle, settled.
