Hon. Lynn M. Egan, (Ret.), senior mediator and arbitrator at ADR Systems, settled a $12.5 million case involving a fire that resulted in the death of one person and severe injuries to two others.
“The case was quite challenging for a variety of reasons, including the number of defendants, the liability and apportionment disputes and the worker’s compensation case that needed to remain open for the benefit of the deceased plaintiff’s family,” Judge Egan said.
Three plaintiffs filed a lawsuit against a water heater manufacturer and an apartment owner for alleged product liability and negligence following a fire. The fire broke out after fumes from a chemical solvent ignited while the three plaintiffs were removing flooring in the apartment. One of the plaintiffs died as a result of his burns, and the two surviving plaintiffs were severely injured.
“Additionally, the case had been unsuccessfully mediated elsewhere, so resolution required all attorneys to maintain faith in the process,” she added. “Their professionalism and mastery of the legal issues at hand helped me guide them to an acceptable and fair compromise.”
The case was resolved on February 5th, just nine days before the trial.
