Hon. William E. Gomolinski, (Ret.), senior mediator and arbitrator at ADR Systems, recently settled a $10 million personal injury case stemming from a 2016 construction site accident.
The parties reached the agreement one day before the trial was to begin.
“Every mediator has to be a chameleon and has to adapt based on the facts of each case,” Judge Gomolinski said. “Especially in these high-value and highly emotional cases, a good mediator never tells the parties what to offer or what to expect.” He added, “Mediators must be patient and allow the process to unfold because these cases can involve many issues in addition to the injury.”
The plaintiff, at the time an independent laborer, had his left foot amputated after it was crushed by a cement mixer while on the job.
