What is Real Estate Mediation?

Real estate mediation is defined as a structured negotiation in which a neutral third-party mediator facilitates discussions between buyers, sellers, developers, property owners, legal counsel and other involved parties to reach a mutually agreeable resolution, which is called a settlement agreement. Unlike litigation, mediation fosters open communication and collaboration, helping parties find solutions that address legal, financial and emotional concerns. Parties control the outcome of the process, and their settlement agreement is enforceable in court, acting as a contract.

Successful Real Estate Mediations at ADR Systems

Our panel of retired judges and seasoned attorneys have settled numerous real estate disputes throughout the multiple decades that ADR Systems has been in business. These have included:

  • A matter involving ownership and easement rights to advertising billboard and revenues; a billboard was straddled two individual properties
  • A matter involving the fraudulent wire transfer of money for a home purchase to a hacker masquerading as the buyer’s attorney
  • A matter involving a public utility that asserted an easement over a property that was not recorded when the purchaser received the title; the title insurance was denied because the purchaser put the property in a trust; issues included whether insurance policy, limiting coverage to named insured, is enforceable by a party who is not a named insured or a successor to that named insured by operation of law

Advantages of Mediating Real Estate Disputes at ADR Systems

Parties to real estate disputes experience various advantages when they mediate their dispute at ADR Systems.

Faster Resolutions: Mediation can resolve disputes in weeks or months rather than years, reducing the time burden on plaintiffs and defendants

Cost Savings: Avoiding lengthy court battles saves money otherwise spent on legal fees, expert witness costs and administrative expenses.

Confidentiality: Unlike public court proceedings, mediation is confidential, protecting reputations and sensitive information.

Reduced Stress: Mediation fosters a collaborative rather than adversarial atmosphere, reducing emotional strain for all involved.

Greater Control: Mediation removes the uncertainty and risk associated with litigation, where outcomes can be all-or-nothing; both parties have a say in the outcome of the case rather than leaving the decision in the hands of a judge or jury.

Preserved Relationships: Open dialogue allows parties to maintain professional relationships when possible.

Experienced Neutrals: ADR Systems’ panel of mediators consist of retired judges and seasoned attorneys with decades of hands-on knowledge of the disputes before them and an ardent passion for resolving them.

I had another first-class service from a first-class organization. We had a very good arbitration experience with Judge Ward.  He was a terrific arbitrator who patiently listened and made all parties feel important, including my client.  And after the arbitration, Judge Ward wrote a thoughtful ruling. Thank you again – ADR Systems is the best!
