Nudelman, (Ret.), senior mediator and arbitrator at ADR Systems, and Jann Johnson, Esq., Chief Operating Officer and Executive Vice President of Marketing at ADR Systems, have published an article in the Winter 2014 edition of the American Bar Association (ABA) Tort Trial and Insurance Practice Section’s The Brief. The article, Premediation Preparation: A Key Component to Successful Dispute Resolution, aims to demystify the complex high-profile mediation process through an analysis of how thorough premeditation preparation can further the goal of settlement. In particular, the mediator’s ability to be an effective leader and process manager is crucial to a successful mediation.
“Mediation requires thoughtful preparation. If the right parties are at the table, and the mediator and parties are well-prepared, agreement and settlement is attainable,” they wrote. “The mediator must set the stage for a successful mediation by leading the parties through the steps in preparation, and defining the mediation process with the help of the parties. The mediator must have a firm grasp of the issues through conducting personal research, reading submissions, and planning, organizing, and conducting premediation meetings. Ultimately, given proper premediation preparation, the key to a productive and successful mediation is how effective the mediator is as a leader. ”
