Judge John Ward, (Ret.) is scheduled to conduct a Q&A on ‘Negotiation and Mediation in Workers’ Compensation’ at Brice Downey & Lenkov on September 20, 2013. Taking the format of a ‘hands on, how-to’ discussion, the focus will be on mediation and settlement from the standpoint of a workers’ compensation lienholder. Judge Ward will give insight into helpful strategy and tactics for settlement issues presented at mediation and pretrial conferences. Questions addressed will include: ‘What should be in the lienholder’s mediation or pretrial memorandum?’ and ‘How do we deal with a plaintiff or defendant who opens with a ‘presumption’ that the workers’ compensation lien will be waived?’

Judge Ward is a senior mediator and arbitrator at ADR Systems. His areas of expertise include personal injury, products liability, insurance coverage, professional liability, and workers’ compensation.
