News

ADR Systems is proud to announce the launch of its Co-Mediation Program, a new offering designed to meet the demands of complex, high-value and multi-party disputes. This program brings together two seasoned mediators to jointly and economically resolve the most complicated cases, offering clients a smarter, more strategic path to settlement.

“With two mediators — often with complementary plaintiff and defense knowledge — combined experience and credibility is leveraged to expedite a settlement that represents all sides,” said Kevin R. Sido, Esq., senior mediator and arbitrator at ADR Systems.

Why Co-Mediation?

Some disputes require more than one neutral to facilitate a successful mediation. Whether it’s a multi-party construction case, a multi-layer insurance conflict or a complex contract case, ADR Systems’ Co-Mediation Program offers a process that moves complicated cases forward.

When paired together, co-mediators bring broader knowledge and experience to the dispute. One mediator leads their efforts, ensuring smooth coordination and continuity. However, they both hone in on specific parties, issues or insurance-related concerns within the case.

This division of effort enhances communication, prevents delays and allows all parties to receive focused attention, saving time and offsetting costs through faster resolution.

Tailored for Complexity

The Co-Mediation Program is ideal for multi-party and multi-issue disputes, as well as significant cases that require extensive coordination, such as:

  • High-value construction issues
  • Multi-layer insurance issues
  • Complex contract issues

Imagine a construction defect dispute involving an owner, a developer, a general contractor, multiple subcontractors, design professionals and several insurers, each with separate counsel and competing interests. Or a contract dispute where delay claims, change orders and liquidated damages span multiple contractual relationships and require simultaneous attention. In these types of cases, the sheer number of parties and legal and technical issues can overwhelm a single mediator.

“Where one mediator might be slowed down by the complexity, two can deliver results,” said Hon. Lisa R. Curcio, (Ret.), senior mediator and arbitrator at ADR Systems. “Co-mediators can divide responsibilities and coordinate legal and factual issues to help parties move toward resolution faster with greater clarity.”

A Custom, Cost-Effective Solution

ADR Systems case managers work closely with counsel to select the right mediators and build a tailored co-mediation plan, which includes the submission timeline, pre-mediation conferences, session scheduling and other preparatory tasks necessary for the co-mediators to be ready to settle the dispute before them. They handle all administrative work so the co-mediators and counsel can focus on settlement.

Throughout the mediation, our co-mediators engage with parties separately when needed, helping reduce downtime and drive consistent progress. Co-mediators are billed at standard hourly rates for their individual time, plus an administrative fee, making this an efficient option for complicated disputes.

Co-Mediate with ADR Systems

Each mediator in ADR Systems’ Co-Mediation Program brings decades of experience as a litigator, judge or full-time neutral. Together, they deliver a deeper, more strategic mediation experience for parties involved in the most challenging personal injury, construction, insurance coverage and contract cases. ADR Systems, It’s Settled.®

I recently had a mediation with Judge John Ward. It had been many years since my last case with him. After the first go around ended unsuccessfully with the numbers "far apart," Judge Ward said that he would circle back with us. And sure enough he did reach back to us, and after a few days of phone calls, we settled. He belongs at the top of your list as a mediator for almost any case.
