Hon. William J. Haddad, (Ret.), senior mediator and arbitrator at ADR Systems, settled a $7.5 million case involving the death of an electrician who fell off an apartment balcony while installing lighting. The case was featured in the Chicago Daily Law Bulletin on December 19th, 2017.

The plaintiff filed a lawsuit in May 2015 against a residential contractor and its subcontractor for negligence in failing to prevent the death of the plaintiff’s husband.

According to the Chicago Daily Law Bulletin article, a construction worker removed balcony railings to install siding at an apartment complex in the suburbs. At the same time, the plaintiff’s husband was installing light fixtures. Construction workers replaced the railing, but failed to properly reattach it before going to lunch.

While on the balcony, another worker asked the plaintiff’s husband to hand him a tool, which caused him to lean on the railing and fall two stories. This resulted in his death three weeks later.

Philip H. Corboy, Jr., partner at Corboy & Demetrio, represented the plaintiff. He said he was more than satisfied with Judge Haddad and the mediation process at ADR Systems.

“Judge Haddad was extremely important to the process that eventually led to settlement,” Corboy said. “He came prepared, knew his facts and, from his years of trying cases, he knew the pressure points. The mediation took two days, but each day we got closer to a resolution. ADR Systems and Judge Haddad played a big role in settling this case to everybody’s satisfaction.”

The settlement was approved one month before a trial was scheduled to begin January 16th, 2018.
