Hon. Lisa R. Curcio, (Ret.), senior mediator and arbitrator at ADR Systems, recently published an article in Building Knowledge, the newsletter of the Illinois State Bar Association Section on Construction Law.
Her article, Overcoming the Fear of Arbitration, identifies common reservations that counsel have about arbitrating construction disputes and recommends actions they can take to mitigate those fears and manage their arbitration proceedings more effectively.
Specifically, Judge Curcio describes how counsel can choose the right arbitrator, select the right arbitration rules, manage arbitration time and cost commitments, and manage multi-track dispute resolution and third-party discovery and testimony. “Armed with the right planning and information, and by using all the tools at their disposal, parties need not fear arbitration,” wrote Judge Curcio. “They may, in fact, find it a highly superior forum for resolving construction disputes.
