Hon. Lisa R. Curcio, (Ret.), senior mediator and arbitrator at ADR Systems, was recently profiled in the American Bar Association (ABA) Forum on Construction Law’s blog, The Dispute Resolver. This is the publication’s first post of the year for its readers, who litigate the very contract, construction, construction defect and mechanic’s lien cases that Judge Curcio focuses on resolving outside of court.
In the profile, Judge Curcio answered questions about her career as a Circuit Court of Cook County judge, how that work prepared her for her present career as a mediator and arbitrator and her approach to arbitrating complex construction disputes in cost-cognizant ways. Because construction disputes can be especially laden with extensive discovery, Judge Curcio believes it is “incumbent on the arbitrator(s) to work with the parties to determine what discovery is really needed for a fair but cost and time efficient resolution.”
Judge Curcio is a proactive advocate of resolving construction disputes through mediation and arbitration, having educated attorneys on this topic at various programs hosted by the ABA Forum on Construction Law, the Society of Illinois Construction Attorneys (SOICA), the Illinois State Bar Association (ISBA) and the Chicago Bar Association (CBA) Construction Law and Mechanic’s Lien Subcommittee. Later this month, her newest article, a guide to overcoming the fears attorneys have about arbitrating construction disputes, will be published by the ISBA Section on Construction Law’s newsletter, Building Knowledge.
