Hon. Margaret A. Brennan, (Ret.), senior mediator and arbitrator at ADR Systems, recently published a Professional Perspective article with Bloomberg Law.

Her article, Use of ADR to Enforce Rights in Cannabis Contracts, explores the use of mediation and arbitration to resolve cannabis-related commercial disputes and why it is a preferable to litigation.

“As more states open the industry to both medicinal and recreational use of cannabis, it will need to adapt and evolve,” writes Judge Brennan in the article. “While the cannabis industry will continue to deal with significant regulation and uncertainty, one area where it can gain some control is through the drafting of contracts that provide for dispute resolution through ADR.”

Judge Burke successfully mediated a complicated case with little chance of being resolved.  He read every word of the parties' submissions, asked astute questions, and worked hard to find a path to resolution.  Judge Burke communicated with the parties themselves - so that they felt they were important participants in working toward resolution. The case I thought was never going to settle, settled.
